TERMS & CONDITIONS

We are Levitation Limited, trading as ODANS Studio ("we", "the company" or "us") and we own and operate the website www.odans.hk ("our website") and ODANS Studio (the “Studio”). Our website offers a convenient way to book and pay for bookings of the Studio.

Please read the following terms and conditions carefully before using our website or booking the Studio. By using our website or any part of it, or by making a booking at the Studio, you agree that you and each person using the Studio booked by you (each a “User”) have read, and accept and agree to be bound by these terms and conditions.

PART A – BOOKING AND PAYMENT

  1. Registration

    1. You must register with us in order to book a room at the Studio through our website. By registering you confirm that you are aged 18 years or above and capable of forming a legally binding contract.

    2. You agree to provide us with accurate, complete and updated registration information; and safeguard your user name and password and not share it with others. You agree that any person using our website with your user name and password is either you or is authorized to act for you.

    3. If we suspect that any information and material supplied by you to us for registration is untrue, inaccurate, outdated or incomplete and etc., we have absolute discretion to cancel any order made by you and/or terminate/cancel your registration with us and in such circumstances, you agree not to raise any claim against us.
       

  2. Booking

    1. When you make a booking, the prices charged are those applicable on the day you book.

    2. Upon successful booking and payment, you will receive an email confirmation to your registered email address. If you do not receive an email, please check your junk mail box first, and then contact us.

    3. We reserve our right not to accept any booking, to cancel any booking, or to deny entry to the Studio by any person at our sole discretion, including without limitation due to non-availability of the selected room at the requested time; or the selected room was listed at an incorrect price due to a human or computer error.
       

  3. Payment, Refund & Rebooking

    1. We accept VISA and MasterCard only. Booking fees will be charged in Hong Kong dollars.

    2. Once paid, no refund will be given for any reason (including sickness or injury). Each paid reservation may only be changed with 5 days prior notice and subject to availability.

    3. If T8 or black rainstorm signal is hoisted within 2 hours before booking start time, and you wish to change the booking time, you may request to change the booking to another time within 30 days of the original booking, subject to availability. If T8 or black rainstorm signal is hoisted during the time slot of the booking, no refund will be given.

    4. If the booked room is unavailable due to emergency repairs, you may request to change the booking to another time within 30 days of the booking, subject to availability.

    5. We use third party payment service to process online transactions. When you make a booking, you agree and accept that your credit card information will be collected, processed, and kept by a payment service provider subject to its terms and conditions. You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making a credit card transaction, and in no event shall any such losses in whole or in part be borne by us.

    6. We do not collect or keep your credit card information. If you choose to save your credit card information for express checkout, you agree and accept that the information will be encrypted and stored by the third party payment service providers.

    7. If the booking is cancelled by us for any reason after you have already made any payment, we will refund the amount paid by crediting back to the same credit card number, or apply the amount as payment for another booking.

    8. Availability information and prices displayed on our website are for reference only and are subject to change at the time of booking.
       

  4. Packages

    1. All packages are for a specific session length time (either 1 hour or 1.5 hours) and time period (either peak or non-peak) only. A package cannot be used to book session of a different length or time period (e.g. a 1 hour peak hour package cannot be used to book 1.5 hours non-peak sessions).

    2. All packages will expire on the expiry date, and any unused credit upon expiry will not be refunded.

PART B – RULES FOR USING THE STUDIO

  1. The person making the booking is liable for the acts and omissions of all Users of the Studio under that booking.

  2. The maximum number of Users permitted in the room must not exceed the maximum permitted by law.

  3. No smoking, eating, alcohol, chewing gum, gambling or illegal substances / activities in the Studio.

  4. The Studio is monitored by CCTV.

  5. Please keep the sound system volume within reasonable levels (and no higher than the indicated maximum volume level) and close the door securely to avoid disturbing the neighbours or triggering complaints. If the User sets the volume higher than the indicated maximum, we will charge the User an extra fee of $1,000, and the User will not be permitted to book the Studio in future.

  6. Please keep the Studio clean and take your rubbish with you. If any User causes any spillage or vomit, the User will be charged a cleaning fee.

  7. Each User may only use the booked room and not any other room. If a User books a room and uses another room, the User will be charged the higher room fee.

  8. All Users must vacate the room at the end of the booked session, whether or not the next session has been booked. If a User uses the room for 10 minutes beyond the end of the booked session, the User will be charged for an extra 30 minutes.

  9. After use, please switch off lights, air conditioning, sound system, and close the door securely.

  10. The passcode will be sent to you before the booking time, please do not disclose it to anyone.

  11.  We do not provide any yoga mats in our studio so please bring your own mat for practice

  12. Users who do not comply with any of the terms and conditions will be asked to leave the Studio without refund, and will not be permitted to book in future.

  13. Please do not disturb users of the other room.

PART C – GENERAL TERMS AND CONDITIONS

  1. Intellectual Property

    1. All intellectual property rights in the content, user content, design, text, graphics and other materials on our website, and the selection or arrangement thereof are owned, controlled or licensed by or to us. Any unauthorized use without our prior written permission is strictly prohibited.

    2. All trademarks, product names and company names or logos used in our website are our property or that of their respective owners. No permission is given by us in respect of the use of any such trademarks, get-up, product names, company names, logos or titles and such use may constitute an infringement of the holder's rights.

  2. General

    1. We may revise these terms and conditions at any time without prior notice by updating our website. The revised terms will take effect when they are posted on our website. If any dispute arises, the company’s decision is final.

    2. We reserve the right at our sole discretion to deny Users access to our website or the Studio without notice and to decline to provide our services to any User that is in breach of these terms and conditions.

    3. Users may not assign, transfer or otherwise deal with their rights and obligations under these terms and conditions without our written consent.

    4. These terms and conditions set forth the entire agreement of the parties and supersede all prior oral or written agreements, understandings or arrangements relating to the subject matter of these terms and conditions. Neither party shall be entitled to rely on any agreement, representation, understanding or arrangement that is not expressly set forth in these terms and conditions.

    5. These terms and conditions are governed by the laws of Hong Kong. You agree to submit to the exclusive jurisdiction of Hong Kong courts. If any part of this agreement is held to be unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remainder will remain in full force and effect.

    6. Additional terms and conditions may apply in relation to promotions and discounts offered from time to time.

  3. Liability

    1. Each User (together with his/her heirs and legal representatives) expressly waives any claim they may have against the company, its directors, shareholders, employees, or contractors for any loss, damage, injury or death suffered as a result of using the Studio.

    2. Each User agrees to indemnify the company, its directors, shareholders, employees, or contractors for any loss, cost or expense suffered as a result of (i) any damage to equipment, fixtures or facilities of the Studio caused by the User; (ii) excessive noise caused by a User; (iii) any breach by a User of these terms and conditions or applicable laws, including but not limited to the Prevention and Control of Disease Ordinance (Cap. 599) and all regulations made thereunder; in each case, such loss, cost or expense may include but is not limited to loss of revenue due to closure, costs of additional renovation work, penalties, fines and legal fees.

    3. Each User agrees that he/she is responsible for his/her own property at all times while at the Studio, and the company is not liable for lost property.

    4. The company makes no representation or warranty in relation to (i) the completeness, quality, operation, use, accuracy, or timeliness of, or the fitness or use for any purpose of, our website; (ii) any services accessed, offered or obtained through our website; (iii) access to our website being uninterrupted; or (iv) whether our website contains any viruses, contaminating or destructive properties.

    5. The company shall not be liable for any damages, loss, costs or expenses arising, directly or indirectly, from your reliance or use (whether authorized or not) of this website.

PART D – PRIVACY POLICY

This Privacy Policy sets out how we may collect, use and disclose your personal information. This Privacy Policy is governed by and observes the requirements of the Personal Data (Privacy) Ordinance (Chapter 486) (the "Ordinance"). By using our website, you agree that we may collect, store, and use information about you in accordance with this Privacy Policy, and you acknowledge and agree to be bound by the terms of this Privacy Policy.

1. Types of Personal Data Collected: We may collect the following personal data: (i) Your name, telephone number, email address; (ii) your credit card information; (iii) your IP address and/or domain name.

2. Use and disclosure of person data collected: Personal data collected by the company may be used for these purposes:

  1. Handling your booking and payment instructions;

  2. Conducting marketing research, statistics analysis, and behavior analysis, to enable us to better understand your characteristics and usage behaviour;

  3. Making disclosures to law enforcement agencies or other government or statutory authorities when required by applicable laws, rules and regulations; to our auditors, accountants and lawyers; and to financial institutions, insurance companies and credit card companies providing services to us;

  4. Direct marketing of the products and services of the company, its related company, and its business partners.
     

3. Direct marketing, access to and correction of personal data: You may receive from us or from our related companies emails and Whatsapp messages containing promotional materials from time to time; if you wish to unsubscribe, or access / correct your personal data held by us, please email us at odanshk@gmail.com.
 

4. Retention of personal data: We retain records of your online transactions for auditing purposes. Our general policy is to retain the information for a reasonable period.
 

5. Use of Cookies: When you browse our website, we use cookies to remember your preferences, to count how many visitors we receive to a page, to help you sign up for our services, to protect your data. You have a choice not to accept the cookies, but to do so you may be unable to utilize or activate certain available functions on our website.
 

6. Amendment: Our Privacy Policy may be amended from time to time by publishing on our website.
